We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

OffMarketAU.com is an online platform that enables users to list and browse off-market real estate properties for sale or rent. We provide a marketplace connecting property owners with potential buyers and tenants. We do not act as a real estate agent, broker, or provide real estate advice.

3. User Accounts

To list a property, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Property Listings

When listing a property, you represent and warrant that:

• You have the legal right to sell or rent the property
• All information provided is accurate and not misleading
• All images are of the actual property and you have the right to use them
• The listing complies with all applicable laws and regulations
• You will respond to inquiries in a timely and professional manner

5. Listing Fees

Property listings require a one-time fee: $99 for rental listings and $129 for sale listings. Fees are non-refundable once a listing is published. Listings remain active for 12 months or until the property is marked as sold/rented. We reserve the right to remove listings that violate these terms without refund.

6. Prohibited Content

You may not list or post content that:

• Is fraudulent, false, or misleading
• Infringes on intellectual property rights
• Violates fair housing laws or discriminates against protected classes
• Contains malware, spam, or harmful content
• Promotes illegal activities

7. Limitation of Liability

OffMarketAU.com is provided "as is" without warranties of any kind. We are not responsible for the accuracy of listings, the conduct of users, or the outcome of any transactions. We do not verify property ownership, condition, or legal status. Users are responsible for conducting their own due diligence before entering into any real estate transaction.

8. Indemnification

You agree to indemnify and hold harmless OffMarketAU.com, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your listings, or your violation of these Terms.

9. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
